Terms of Service

1. Operator & acceptance

Sale Spotted! (“the Service”) is operated by Sale Spotted, Inc. (“we,” “us,” “our”). By creating an account, clicking accept, or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service.

2. What the Service is

Sale Spotted! is a community map for discovering and listing time-limited yard, garage, estate, and similar local sales. Listings are user-generated. We do not guarantee that any sale is open, accurate, safe, legal, or as described. Always use common sense when visiting private property and verify information yourself.

3. Eligibility (18+)

You must be at least 18 years old to create an account or use the Service. By signing up you represent that you are 18 or older. We do not knowingly allow accounts for minors. If we learn an account belongs to someone under 18, we will terminate it and delete associated personal data as required by law.

4. Accounts

You are responsible for your credentials and all activity under your account. Provide accurate information. We may suspend or terminate accounts that violate these Terms, our Community Guidelines, or that pose safety, abuse, fraud, or legal risks. Appeals may be requested via Contact Us.

5. Publishing locations & visibility

Creating or reporting a sale stores a precise location so the listing can be mapped and verified. Public discovery may show a privacy-redacted or approximate pin, including for community-spotted sales without a verified host. You must have the right to submit that location (e.g., you are the host, or you are reporting a sale you observed in public).

• Public visibility: guests (not signed in) and signed-in users can see the listing on the map and in detail views.
• Signed-in only: only authenticated users can see the listing (guests cannot). Available when you create a sale as the host.
• Community reports (“Sale Spotted”) are public by default so neighbors can find and verify them.

Publishing a home or private address can create safety and privacy risks. You are solely responsible for choosing what to post.

6. Community rules (summary)

Full rules live in the Community Guidelines. You agree not to post or use the Service to:

• List or promote illegal items, stolen goods, weapons where prohibited, or controlled substances
• Post sexual, pornographic, exploitative, or any content involving minors
• Harass, threaten, stalk, doxx, or endanger others
• Spam, scam, phishing, or mislead about sale times, locations, or goods
• Impersonate others or attempt to bypass rate limits, access controls, or security
• Scrape or resell Service data except under a licensed Partner API agreement

We may remove content, hide sales, suspend users, and report illegal material to authorities (including NCMEC for CSAM) as appropriate.

7. User content license

You retain ownership of content you upload. You grant Sale Spotted, Inc. a worldwide, non-exclusive, royalty-free license to host, store, display, moderate, and process that content solely to operate and improve the Service (including signed URL delivery, backups, and abuse prevention). You represent you have all rights needed to grant this license.

8. Copyright / DMCA

If you believe content on the Service infringes your copyright, send a notice including: (a) your contact information; (b) description of the work; (c) URL or sale ID of the material; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that the information is accurate and you are authorized; and (f) your physical or electronic signature. Send notices via Contact Us with subject “DMCA / Copyright.” We may remove material and, where appropriate, terminate repeat infringers.

9. Reporting abuse & illegal content

Use the in-app Report control on a sale (flag icon) for spam, unsafe, illegal, or misleading listings—this is the fastest path for moderators to review and take down verifiable problems. You may also use Contact Us. Do not misuse reporting to harass hosts.

10. Location, safety & real-world risk

Map pins, addresses, proximity features, and optional stored location for push require your choices and (where applicable) browser permission. We are not a backgrounding or emergency service. You are solely responsible for personal safety when attending sales. Sale Spotted, Inc. is not liable for interactions between users, property damage, theft, injury, or crime associated with listed locations.

11. Optional features

Payments (e.g. Stripe), Partner API data access, push notifications, routing providers, and safety features such as registry-based proximity notices (if enabled) may be offered under additional terms or flags. Features may be unavailable or changed without notice.

12. Third-party services & map data

The Service relies on third parties (for example Supabase, Cloudflare, and map data sources such as OpenStreetMap via Protomaps). Their terms and privacy practices also apply to their processing. Map basemap data is subject to OpenStreetMap and related licenses; attribution is shown on the map where technically feasible.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted availability, map accuracy, reputation scores, or that listings are safe or lawful.

14. Limitation of liability

To the maximum extent permitted by law, Sale Spotted, Inc., its founder, officers, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from user content, third-party services, map or registry data, or visits to listed sales. Our aggregate liability for claims relating to the Service is limited to the greater of (a) amounts you paid us in the 12 months before the claim or (b) USD $50.

15. Indemnity

You agree to defend and indemnify Sale Spotted, Inc. against claims arising from your content, your use of the Service, or your violation of these Terms or applicable law.

16. Governing law

These Terms are governed by the laws of the United States and the State of North Carolina, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply. Venue for disputes will be state or federal courts located in North Carolina, unless applicable law requires otherwise.

17. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes constitutes acceptance where permitted. Material changes may be highlighted in-app or by email when practical.

18. Complimentary benefits

During beta, confirmed community spots can earn a Cold Start badge and limited complimentary access to Host Pro benefits (listing photos, message distance, route stops, and in-app navigation). That access is a grant on the account. It is not a paid subscription, and it does not include free boost placements. The number of confirmed spots required for complimentary Host Pro access, and whether that access is offered, may change at any time.
